1.ACCEPTANCE OF TERMS

Thank you for choosing HedgerX Exchange. The following Terms and Conditions and the Privacy Policy (together, the “Terms”) apply to any person that registers for and/or opens a HedgerX Exchange Account through HedgerX.my or any associated mobile applications, website, or APIs (together, the “HedgerX Exchange Site”).

The Terms constitute a legally binding agreement between you and HedgerX Exchange Malaysia Sdn. Bhd. For the purposes of these Terms, any reference to “we” “us” “our” “HedgerX Exchange” and/or any similar term shall be construed as reference to HedgerX Exchange Malaysia.

By registering for and opening a HedgerX Exchange Account, you unconditionally accept these Terms and agree to be bound by and act in accordance with them. You also accept and agree that you are solely responsible for understanding and complying with all laws, rules, regulations and requirements of the jurisdiction in which you live that may be applicable to your use of the HedgerX Exchange Site and/or your HedgerX Exchange Account, including but not limited to, those related to export or import activity, taxes or foreign currency transactions. Depending on your country of residence, you may not be able to use all the functions of the HedgerX Exchange Site.

Please read these Terms carefully before using the HedgerX Exchange Site because they affect your legal rights and obligations.

2.AMENDMENT OF TERMS

HedgerX Exchange may amend the Terms from time to time. You should visit the HedgerX Exchange website regularly to check when the Terms were last updated (as displayed at the top of this document) and to review the current Terms. We will do our best to notify you of any amendments to the Terms that we consider likely to materially affect your rights and obligations. Any such notice will be posted on the HedgerX Exchange Site, or sent by email to the address associated with your HedgerX Exchange Account

The continued use of your HedgerX Exchange Account, after any amendment to these Terms, constitutes your acceptance of the Terms, as modified by such amendment. If you do not accept the Terms, or any amendment to them, you must immediately stop using the HedgerX Exchange Site and your HedgerX Exchange Account.

3.ELIGIBILITY

By opening a HedgerX Exchange Account, you expressly warrant and represent that:

You are 18 years of age or over and have full capacity to accept the Terms and enter any transaction available through the HedgerX Exchange Site;
You will not open, or attempt to open, a HedgerX Exchange Account under any name except your own; or use your HedgerX Exchange Account to carry out transactions on behalf of a third party;
You will follow the HedgerX Exchange Business account application process if you seek to open and use a HedgerX Exchange Account for a non-individual legal entity;
You will not have more than one HedgerX Exchange Account; use or access any HedgerX Exchange Account other than your own; or assist any other person in obtaining unauthorised access to any HedgerX Exchange Account;
You will provide security for transactions carried out through your HedgerX Exchange Account by ensuring there is sufficient cryptocurrency (as the case may be) in your HedgerX Exchange Account in advance of any transaction;
You will not allow or facilitate the deposit of into your HedgerX Exchange Account unless that deposit is made in accordance with the Deposit Requirements (see Deposits);
You will not allow or facilitate the withdrawal of Currency from your HedgerX Exchange Wallet to a account held in the name of a third party (see Withdrawals); and You will not use your HedgerX Exchange Account for or in relation to any illegal activity, any Prohibited Activity, in violation of any laws, statutes, ordinances or regulations.

By opening a HedgerX Exchange Account you accept and agree that HedgerX Exchange may, without further notice and in its sole discretion, terminate, suspend or restrict the account of any customer who uses, or who we reasonably suspect may be using, the HedgerX Exchange Site or any HedgerX Exchange Account in a manner that is inconsistent with the letter or spirit of these Terms.

4.RISKS

Before using the HedgerX Exchange Site, you should ensure that you understand the risks involved in buying, selling or trading cryptocurrencies. Cryptocurrency markets can be volatile and prices can fluctuate significantly, which could result in sudden and significant increases or decreases in the value of your assets. This market volatility and other risks involved in buying, selling or trading cryptocurrencies are explained on the Risk Warning page of the HedgerX Exchange website. There may be additional risks not identified in these Terms or in the Risk Warning.

You should carefully assess whether your financial situation and risk tolerance is suitable for buying, selling or trading cryptocurrency. You accept and agree that you are solely responsible for any decision to buy, sell, trade or otherwise hold or deal with cryptocurrency.

5.ELECTRONIC COMMUNICATIONS

You accept and agree that:

any communications, agreements, notices and/or any other documents (together “Communications”) relating to your HedgerX Exchange Account or your use of HedgerX Exchange’s services will be provided to you electronically by posting them on the HedgerX Exchange Site, emailing them to the email address you have provided to us, or through any other form of electronic communication. You consent to receiving all Communications electronically;
you will at all times have available to you the necessary hardware and software to receive, access and retain Communications sent to you electronically, including a device with an internet connection and a valid and accessible email address;
you assume full responsibility for providing HedgerX Exchange with a valid and accessible email address to which any Communications may be sent, and for ensuring that email address and any other contact information is kept up to date. Any Communication sent to the email address you have provided to us will be deemed to have been received by you. You can amend your contact information by signing-in to your HedgerX Exchange Account and accessing the Settings page.

You may at any time withdraw your consent to receiving Communications electronically by contacting support@HedgerX.my. You acknowledge that failure to give, or withdraw, consent to receiving Communications electronically puts the security of your HedgerX Exchange Account at risk (see Account Security) and that HedgerX Exchange reserves the right to close your HedgerX Exchange Account in the event you fail to give, or withdraw, your consent to the receipt of Communications electronically.

6.IDENTITY VERIFICATION

HedgerX Exchange implements and maintains the highest standards of Know Your Customer (“KYC”) processes and controls as part of our commitment to combating fraud and assisting in the prevention of money laundering and terrorist financing.

To ensure we meet these standards, our customers are required to provide certain personal details and documents when opening a HedgerX Exchange Account (“Identity Verification”). The nature and extent of the Identity Verification required will depend upon which of our supported countries you are resident in, and the deposit and withdrawal limits that you wish to apply to your HedgerX Exchange Account. In certain circumstances, HedgerX Exchange may also perform enhanced due diligence (“EDD”) procedures in relation to your HedgerX Exchange Account. You accept and agree that you will remain subject to such procedures at all times.

HedgerX Exchange reserves the right to, at any time:

restrict or suspend your HedgerX Exchange Account when we, in our sole discretion, consider it necessary to carry out further Identity Verification and/or EDD; or
terminate your HedgerX Exchange Account if you provide, or we suspect you have provided, false information or refuse to provide information we require for Identity Verification and/or EDD

You accept and agree that there may be delays in accessing your HedgerX Exchange Account, or in carrying out transactions through your HedgerX Exchange Account, while we undertake any Identity Verification and/or EDD procedures.

Retention of information. HedgerX Exchange is required to retain certain information and documentation obtained as part of the Identity Verification and EDD procedures. These requirements apply even when you have terminated your relationship with HedgerX Exchange. We reserve the right to keep such information and documentation for the required period and you accept and agree that information and documentation you provide to HedgerX Exchange may be retained by us, including following the closure of your HedgerX Exchange Account.

7.Deposit

HedgerX Exchange (hereinafter referred to as “HedgerX Exchange” or “we”) provides users (“you” or “users”) with digital asset deposit services (“Deposit”). Before using the deposit services on this platform, please carefully read and agree to the following terms. These terms are supplementary to the HedgerX Exchange Terms of Service and have the same legal effect as the main terms.

Supported Assets for Deposit

The list of supported assets for deposit is as shown on the deposit page.
Depositing unsupported assets to an incorrect address may result in permanent loss of funds. The platform shall not be held responsible for such incidents.

Deposit Address and Tag

You must obtain your designated deposit address (including but not limited to the address and Tag/Memo, if applicable) through your account on the platform.
Please carefully verify the address information before proceeding. Deposits made to incorrect addresses cannot be recovered.
For assets that require a Tag/Memo, failure to correctly include the required information may result in the deposit not being credited to your account.

Blockchain Confirmation & Deposit Time

The time required for deposits to be credited depends on the asset type and the blockchain network, and typically requires a certain number of block confirmations.
The standard confirmation requirements are shown on the deposit page, where you can monitor the progress in real time.

Minimum Deposit Amount

Each asset has a minimum deposit amount. Deposits below this amount will not be credited and cannot be refunded.

Exception Handling

In cases where deposits are delayed due to blockchain congestion, node synchronization delays, or other factors, the platform will process the deposit as soon as possible but shall not be held liable for such delays.
If a deposit issue arises (such as missing Memo/Tag or unbroadcasted transactions), please contact customer support in a timely manner and provide the necessary information to assist in resolving the issue.

Security and Compliance Requirements

All deposit activities must be legal and compliant. The platform reserves the right to freeze or delay processing of suspicious transactions in accordance with laws, regulations, and risk control requirements.
The platform also reserves the right to require users to complete identity verification (KYC) or provide proof of source of funds when necessary.

Disclaimer

Blockchain transactions are irreversible. The platform shall not be responsible for any errors or loss of assets caused by user mistakes.
Users must ensure their deposit operations comply with the platform’s latest requirements. The platform reserves the right to update the list of supported assets or related rules without prior notice.

Right of Amendment and Interpretation

The platform may modify these terms at any time in accordance with business needs or legal requirements. Changes will take effect immediately upon publication on the website.
The final interpretation of these terms belongs to HedgerX.

By depositing assets to a HedgerX Exchange address, you acknowledge that you have read, understood, and accepted these Deposit Terms of Use and other relevant platform rules.

8.Withdrawal

These Withdrawal Terms of Use (hereinafter referred to as “Terms”) apply to all user actions (“you” or “users”) when performing digital asset withdrawals on HedgerX Exchange (hereinafter referred to as “the platform” or “we”). These Terms are supplementary to the HedgerX Exchange Terms of Service and have the same legal effect.

By using the withdrawal function of the platform, you acknowledge that you have read, understood, and accepted all contents of these Terms.

Withdrawal Eligibility

Only users who have completed KYC (Know Your Customer) verification are eligible to withdraw.
Your account must remain in good standing (not frozen, suspended, or restricted) in order to submit a withdrawal request.

Withdrawal Address Management

You must ensure that the withdrawal address you provide is correct, valid, and under your control.
HedgerX Exchange is not responsible for any loss of assets due to incorrect addresses or transfers to third-party platforms.
For certain assets, Tag/Memo or similar information may be required for withdrawal; failure to provide this information may result in permanent loss of assets.

Withdrawal Processing Time

Withdrawals are generally processed within minutes to a few hours after the request is submitted, depending on blockchain network congestion and risk control review.
In some cases (such as manual review, large withdrawals, or compliance checks), processing time may be extended.

Withdrawal Limits

Daily withdrawal limits are determined by your user level and KYC verification level. You can view your current limits on the account page.
The platform may temporarily adjust withdrawal limits or suspend withdrawals without prior notice, especially during system maintenance, market anomalies, or compliance investigations.

Fees

All withdrawals are subject to network fees, which are based on blockchain conditions and platform policies.
The platform reserves the right to adjust fees in response to network changes. You should confirm the final fee before submitting a withdrawal request.

Risk Control & Compliance

To ensure platform security and compliance, HedgerX Exchange reserves the right to manually review, delay, or refuse certain withdrawal requests, particularly in the following situations:
- Abnormal login environments (e.g., VPNs, proxy IPs, remote control);
- Suspicious asset sources or suspected money laundering;
- Abnormal multi-device login behavior or suspected account compromise;
- Unusual withdrawal frequency or amounts.
When necessary, the platform may require users to provide additional identity documents or proof of source of funds.

Force Majeure & Disclaimer

HedgerX Exchange shall not be liable for withdrawal delays caused by blockchain network congestion, third-party node service disruptions, or force majeure events.
Losses resulting from user errors (such as incorrect address input or wrong Memo/Tag) will not be compensated by the platform.

Amendments & Termination

The platform reserves the right to modify, suspend, or terminate all or part of the withdrawal services at any time without prior notice.
Revised Terms take effect upon publication. Your continued use of the withdrawal services constitutes acceptance of the revised Terms.

By submitting a withdrawal request on HedgerX Exchange, you agree to abide by these Withdrawal Terms of Use as well as other applicable platform agreements and policies.

9.Trading

Welcome to the trading services provided by HedgerX Exchange (hereinafter referred to as “the platform” or “we”). These Trading Terms of Use (“Terms”) are supplementary to the HedgerX Exchange Terms of Service and apply to all trading activities conducted by users (“you” or “users”) on the platform. By using the trading services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

Scope of Trading Services

HedgerX Exchange offers a variety of digital asset trading services, including but not limited to: spot trading, margin trading, contract trading, and other innovative products.
All trades are executed voluntarily and independently based on users’ own judgment. The platform assumes no responsibility for any trading decisions or suggestions.

Trading Account Requirements

Users must complete account registration and KYC (Know Your Customer) verification to access trading services.
Users must ensure that the account information provided is true, accurate, and complete. Any legal consequences arising from false information shall be borne by the user.
Users may not use another person’s account or authorize others to use their own account for trading.

Trade Execution Rules

Once an order is submitted and matched, the trade is considered final and irreversible, unless the order fails due to a system error or market anomaly.
Trades are matched automatically based on real-time market depth and prices. The platform does not guarantee full execution of orders.
The platform is not responsible for losses due to slippage or other execution differences caused by network delays, system errors, or extreme market conditions.

Trading Fees

All trades are subject to fees as specified in the latest fee schedule published by the platform.
The platform reserves the right to adjust the fee structure based on market conditions. Any changes will be announced in advance.
If a user's account balance is insufficient to cover the relevant fees, the platform reserves the right to cancel the corresponding orders.

Market Conduct Guidelines

Users shall not engage in the following prohibited behaviors during trading:

Manipulating market prices (e.g., pump and dump, fake orders);
Exploiting system loopholes or abnormal market conditions for arbitrage;
Abusing trading interfaces with high-frequency or unauthorized activity (except for approved API users);
Collusive trading with other users to disrupt normal market order;
Violating local laws, engaging in money laundering, or financing terrorism.

The platform reserves the right to restrict trading, freeze assets, or permanently suspend accounts involved in such behavior.

Risk Disclaimer and User Responsibility

Digital assets are subject to high market volatility. Users should have the ability to identify risks and the financial capacity to bear potential losses.
Users are solely responsible for the outcomes of their trading activities, including profits and losses. The platform assumes no liability for user losses.
In extreme market conditions, the platform reserves the right to adjust trading parameters, restrict order placements, or suspend trading services to maintain market stability.

Technical Interruptions and System Maintenance

The platform will make reasonable efforts to ensure the stability and security of trading systems but does not guarantee uninterrupted or error-free service.
In the event of service disruption due to system maintenance, network failure, hacking attacks, or force majeure, the platform will work to restore services as soon as possible but will not be held liable for any resulting losses.

Amendments and Interpretation

The platform reserves the right to update these Terms at any time in accordance with business development or legal and regulatory changes. Updates will be published through official announcements.
By continuing to use the trading services, you are deemed to have accepted the revised Terms.
The final interpretation of these Terms belongs to HedgerX Exchange.

10.Account Security

HedgerX Exchange places great importance on security. The measures we take to protect your HedgerX Exchange account are outlined on the “Security” page of the HedgerX Exchange website. However, you are solely responsible for the following:

Maintaining adequate security and control over your HedgerX Exchange account login credentials, including but not limited to any passwords, personal identification numbers (PINs), API keys, or any other codes associated with your HedgerX Exchange account;
Enabling any additional security features available to you, including activating two-factor authentication (2FA) on your HedgerX Exchange account;
Keeping your contact information up to date so that you can receive any security-related notifications or alerts we may send you;
Securing and maintaining control over the email account, phone number, and two-factor authentication application or device associated with your HedgerX Exchange account.

Failure to take the above measures or any other available security precautions may result in unauthorized access to your HedgerX Exchange account, potentially leading to the loss or theft of any cryptocurrency held in your HedgerX Exchange wallet, associated accounts, or saved addresses. HedgerX Exchange accepts no liability for any unauthorized access to your account (provided such access is not due to HedgerX Exchange’s fault), nor for any failure on your part to act upon notifications or alerts sent to you.

Your HedgerX Exchange account security may be compromised by phishing, scams, or other attacks, as well as computer viruses, spyware, scareware, Trojan horses, worms, or other malicious software that may affect your device. HedgerX Exchange strongly recommends that you use reputable antivirus and anti-malware software regularly and remain vigilant against phishing attacks, especially through SMS, email services, and search engines.

You should exercise caution when reviewing messages that claim to be from HedgerX Exchange. If you have any doubts about the authenticity of a communication, you should log in to your HedgerX Exchange account directly through the official HedgerX Exchange website (specifically, www.HedgerX.my, and not any other domain claiming to be associated with HedgerX Exchange) to review any transactions or required actions.

To the fullest extent permitted by applicable law, you acknowledge and agree that you are solely responsible for all activity that occurs within or through your HedgerX Exchange account and that you assume all risks of any unauthorized or authorized access to your account.

Private Keys.HedgerX Exchange securely stores all private keys (“Private Keys”) associated with the supported cryptocurrencies in any HedgerX Exchange account. You acknowledge and agree that HedgerX Exchange retains control over the private keys associated with your account and that you have no right to access, control, or use such private keys. Specifically, and without limiting the generality of the foregoing, HedgerX Exchange will not:

Accept or comply with any instruction to sign data using a private key;
Permit access to any funds associated with your private keys, except for the supported cryptocurrencies held in your HedgerX Exchange wallet;
Allow the creation of any receiving address associated with a private key, except for addresses generated through your HedgerX Exchange wallet.Unless funds are received through a receiving address generated by your HedgerX Exchange wallet, HedgerX Exchange will not credit any cryptocurrency associated with a private key to your HedgerX Exchange wallet.

11.Closing Your Account

You may request to close your HedgerX Exchange account by submitting a closure request through the Help Center. HedgerX Exchange will process such requests only if the following conditions are met:

The total balance of all cryptocurrencies in your HedgerX Exchange account is below the minimum closure amount;
No transactions have occurred in your HedgerX Exchange account for at least 30 days.

These requirements are intended to protect you from potential loss, and HedgerX Exchange will only process closure requests once they are satisfied.

You acknowledge and agree that once your HedgerX Exchange account is closed:

You will no longer have access to it;
HedgerX Exchange is under no obligation to notify you of or provide you with any cryptocurrencies sent to any receiving address associated with your HedgerX Exchange account;
HedgerX Exchange reserves the right (but not the obligation) to delete all your stored information and account data from our servers, while retaining any information necessary for legal or operational purposes.

If, on the date of account closure, your HedgerX Exchange wallet still contains any cryptocurrency (i.e., the total balance is below the minimum closure amount), you acknowledge and agree that HedgerX Exchange will retain such funds and you will no longer have any claim to them. The minimum closure amount is $10.00 USD or its equivalent in local currency.

You further agree that HedgerX Exchange shall not be liable to you or any third party for closing your account, terminating your access, or deleting your information or account data.

12.Disclaimer

The HedgerX Exchange website, your HedgerX Exchange account, and any related products or services are provided strictly on an “as is” and “as available” basis. HedgerX Exchange expressly disclaims, and you waive, all express or implied warranties. Without limiting the generality of the foregoing, no warranties of merchantability or fitness for a particular purpose are made with respect to the HedgerX Exchange website, your account, or any related products or services.

Some jurisdictions do not allow the exclusion of implied warranties in consumer contracts, so some or all of the disclaimers in this section may not apply to you.

13.Miscellaneous

Change of Control. In the event that HedgerX Exchange is acquired by or merged with a third party, we reserve the right to transfer or assign the information we have collected from you as part of such merger, acquisition, sale, or other change of control.

Force Majeure. HedgerX Exchange shall not be liable for any delay, failure to perform, or interruption of service resulting directly or indirectly from causes beyond our reasonable control. These may include, but are not limited to, acts of God, civil or military authorities, acts of terrorism, civil disturbances, wars, strikes or other labor disputes, fires, interruptions in telecommunications or internet services or network provider services, hardware or software failures, or other disasters or events beyond our reasonable control.

Headings. Section titles in these terms are for convenience only and shall not affect the meaning or interpretation of any provision.

English Language Prevails. If these terms are translated into any language other than English, such translation is provided for convenience only. The meaning of the terms, conditions, and statements herein shall be governed by the English version, which shall prevail in the event of any discrepancy between the English version and a translated version.
